NOIRELLE — Terms of Service

By accessing this website and/or completing a purchase, you confirm that you have read, understood, and agree to be bound by these Terms of Service in their entirety. If you do not agree, you must not use this site or place any order.

1. General Conditions

NOIRELLE reserves the right to refuse service to any person, for any reason, at any time, without prior notice or liability. By accessing this site and completing a purchase, you expressly and irrevocably agree to be bound by these Terms of Service. Any breach of these terms may result in immediate cancellation of your order without refund, at NOIRELLE's sole discretion. These Terms apply to all users of the site, including browsers, customers, and any other individuals who access our content.

2. Accuracy of Information

The content published on this site is provided for general informational purposes only. While NOIRELLE makes reasonable efforts to ensure the accuracy of product descriptions, specifications, pricing, and other content, we do not warrant that such information is complete, current, or free of error at all times. Your use of any information on this site is entirely at your own risk. NOIRELLE expressly disclaims any liability arising from reliance on information published on this site.

3. Pricing & Service Modifications

All prices are listed in U.S. dollars and are subject to change at any time without prior notice. NOIRELLE reserves the right to modify, suspend, or permanently discontinue any product, service, or feature at any time, without liability to you or any third party. Promotional pricing, discount codes, and limited-time offers are subject to availability and may be withdrawn at any time without notice.

4. Product Display

NOIRELLE makes every reasonable effort to display products as accurately as possible, including colors, dimensions, and materials. However, we cannot guarantee that your device's display settings, screen calibration, or resolution will accurately reproduce the exact appearance of the physical product. Patent leather in particular reflects light differently depending on photography conditions and your screen settings. Minor visual differences between product images and the physical item received do not constitute grounds for a return, refund, or dispute of any kind.

5. Footwear Sizing & Fit — User Responsibility

This section constitutes a material term of this agreement. By purchasing any NOIRELLE footwear product, you expressly acknowledge and accept the following:

5.1 Size Selection
NOIRELLE provides a detailed size chart on every product page prior to purchase, including US, EU, and UK size conversions. The customer is solely and exclusively responsible for selecting the correct size at the time of purchase. NOIRELLE assumes no responsibility for sizing errors made by the customer, including but not limited to selecting an incorrect size, misreading the size chart, or ordering based on size conventions from a different market.

5.2 Fit Variation
Footwear fit varies by individual foot anatomy, including foot width, instep height, and toe shape. NOIRELLE cannot guarantee that any product will accommodate every foot shape within a given size. Fit discomfort or incompatibility due to individual anatomy does not constitute a manufacturing defect and does not qualify for a return or refund.

5.3 Heel & Platform Use
NOIRELLE products include high-heel and platform styles. The customer assumes full and sole responsibility for safe use of these products, including but not limited to use on appropriate surfaces, in appropriate conditions, and with appropriate physical capability. NOIRELLE expressly disclaims all liability for any injury, fall, or harm resulting from the use of its footwear products, including injuries sustained on wet, uneven, or unstable surfaces.

5.4 Material Characteristics
By purchasing, the customer acknowledges that patent leather and transparent acrylic heels present inherent material characteristics — including minor surface variations, micro-bubbles, and light reflection differences — that are not manufacturing defects. Claims based on these characteristics will not be accepted.

6. Order Limitations & Cancellations

NOIRELLE reserves the right to refuse, limit, or cancel any order at its sole discretion, including but not limited to orders that appear fraudulent, abusive, resold commercially without authorization, or placed in unusually high quantities. Purchase limits may be applied per person, per household, or per order, at NOIRELLE's sole discretion. In the event of a cancellation initiated by NOIRELLE, we will make reasonable efforts to notify you at the email address provided at checkout. If payment has been collected, a full refund will be issued.

7. Errors & Omissions

Typographical errors, pricing inaccuracies, or incorrect product information may occasionally appear on this site. NOIRELLE reserves the right to correct any such errors and to cancel any affected orders — including after an order confirmation has been issued — without liability of any kind beyond a full refund of the amount paid. You will be notified via email if your order is cancelled for this reason.

8. Intellectual Property

All content on this site, including but not limited to the NOIRELLE name, logo, product images, descriptions, and copy, is the exclusive intellectual property of NOIRELLE and is protected under applicable Mexican law, including the Ley Federal del Derecho de Autor and the Ley de la Propiedad Industrial, as well as applicable international intellectual property treaties to which México is a signatory. Any unauthorized reproduction, distribution, modification, public display, or commercial use of any content from this site is strictly prohibited and may result in legal action.

9. Limitation of Liability

To the maximum extent permitted by applicable law, NOIRELLE — including its owners, operators, employees, suppliers, and affiliates — shall not be held liable for any indirect, incidental, special, punitive, or consequential damages of any kind arising from the use or inability to use our products or this website, any injury or harm resulting from use or misuse of any footwear product including falls or injuries related to heel height, delays, errors, or interruptions in service, or any reliance placed on information published on this site. In all cases, NOIRELLE's total aggregate liability shall not exceed the amount actually paid by the customer for the specific order giving rise to the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless NOIRELLE and its owners, operators, employees, and affiliates from and against any and all claims, demands, damages, losses, costs, and expenses — including reasonable legal fees — arising out of or related to your use or misuse of any NOIRELLE product, your violation of these Terms of Service, any injury to yourself or a third party resulting from your use of the product, or your violation of any applicable law or regulation.

11. Governing Law & Jurisdiction

These Terms of Service are governed exclusively by the laws of the United Mexican States, without regard to conflict of law principles. Any dispute, claim, or controversy arising from or relating to these Terms, a purchase made through this site, or the use of any NOIRELLE product shall be subject to the exclusive jurisdiction of the competent courts of Mexicali, Baja California, México. By completing a purchase, the customer expressly waives any objection to this jurisdiction and agrees that Mexican law shall apply in all cases, regardless of the customer's country of residence or the location of delivery. No legal action against NOIRELLE may be filed in any court outside of Mexicali, Baja California, México.

12. Modifications to These Terms

NOIRELLE reserves the right to update or modify these Terms of Service at any time without prior notice. Changes will be effective immediately upon publication on this site. Your continued use of the site or placement of an order following any modification constitutes your acceptance of the updated Terms.
